Jury says Flint man guilty of 2009 killing outside nightclub

Published: Tuesday, September 11, 2012, 6:16 PM

By Dominic Adams | dadams5@mlive.com

Flint, MI -- A jury after days of deliberation declared Johnnie Tyrell Johnson Jr. guilty of murder and other charges Tuesday in the 2009 shooting death of a man outside a Flint nightclub.

On June 14, 2009, Demario Dupree was walking outside of Club What’s Next near Pasadena Avenue and Clio Road in Flint Township when Johnson ran around the corner shooting at Dupree with an AK-47, the Genesee County Prosecutor’s Office said in a statement.

Dupree was hit seven times, the statement said, and died at the scene.
The case went to the jury on Thursday.

Dupree was in a car at the club, which has a Flint address, but police found him a few feet away in Flint Township.

Dupree’s killing was in retaliation for the alleged homicide of Deion Smith in 2006, the prosecutor’s office said in an email. There were no other details available on that case or if any charges had been filed, the email said.

Sentencing for Johnson is scheduled for Oct. 15. He also was convicted of being a felon in possession of a firearm and third-offense felony firearms.

He is currently serving time at Carson City Correctional Facility for carrying a concealed weapon and second-offense felony firearm.

Johnson also is also facing charges of open murder and conspiracy to commit murder in the 2007 slaying of Margaret Ernest.

Johnson is accused of acting as an accomplice when Ernest, 44, was shot to death on the porch of her Witherbee Street home on May 30, 2007.

They had Copeman and Chevrolet roped off & officers were swarming all over the area. There were also scanner calls about an assault nearby that the caller said was related to the shooting. Also many calls for shots fired in the Welch & Chevrolet area at the same time. Plus, a friend told me she saw the ATF in the area last night.

Flint man killed during argument over payment for planned arson, authorities say

Published: Tuesday, September 11, 2012, 6:30 PM

By Gary Ridley | gridley@mlive.com

FLINT, MI -- Prosecutors say an argument between two men over payment they were to receive for an arson they were hired to commit at a Dollar General store led to the death of one of the men.

Genesee County SheriffCarl Holyfield Jr.
Carl Douglas Holyfield Jr., 34, was arraigned via video from the Genesee County Jail today by Flint District Judge Tracy Collier-Nix on open murder and arson-preparation to burn property worth $20,000 or more.

Collier-Nix ordered Holyfield held without bond.

The city's 911 center received a call at 5:19 a.m. Sunday in reference to a reckless vehicle in the area of Thom and Cook, followed by another call of a man down. A man was found laying dead in the street from a head injury when authorities arrived.

Police have yet to release the name of the victim, but he is listed in court records as Timothy Smith.

Prosecutors say Smith and Holyfield were hired to commit an arson at a Dollar General store and that an argument ensued over the payment they were to receive for the fire.

Flint Police officials could not be reached for comment on the case.

Collier-Nix also arraigned Holyfield today on two separate charges of driving while license suspended in July.

These charges are not Holyfield's first run-in with the law.

Holyfield has served time in prison for a 2006 Wayne County charge of felony firearm, two counts of delivering/manufacturing less than 50 grams of cocaine from 2003 in Genesee County and a 1999 charge of first-degree home invasion in Wayne County, according to the Michigan Department of Corrections.

The Michigan Department of Corrections also shows he served a probation sentence for felon in possession of a firearm.

MDOC officials confirmed that he is currently on parole.

He is scheduled to be back in court Sept. 18 for a pre-trial hearing.

Homicide in apparent home invasion has Flint north side residents worried about violence

Published: Friday, September 14, 2012, 12:10 PM

By Shaun Byron | sbyron@mlive.com

Shaun Byron | MLiveFlint police investigatet a homicide that happened early Friday, Sept. 14, 2012, at a home near the corner of Saginaw Street and Philadelphia Boulevard.

FLINT, MI -- Investigators are still trying to piece together the facts involving a fatal shooting early Friday on Flint's north side.

Initial reports from Flint police are that it was a home invasion and robbery that turned violent.

The victim was visiting at the time of the shooting, according to police, who had no other details about the person's identity.

"I can't even talk about it right now," said a man who stated he lives in the home.

Neighbors reported seeing police lights as early as 5 a.m.

Darelle James of Louisiana said he is visiting his girlfriend who lives in the neighborhood and woke up to police lights like everyone else.

James said knowing a homicide happened so close to her home has him concerned.

Sam Uelar, a Flint firefighter, also lives in the neighborhood and said the people living in the area work to keep their yards nice and don't want to see crime take over.

"My neighbor left to take her husband to work at 4:15 this morning," Uelar said. "That Suburban wasn't in the driveway (of the house where the shooting happened)."

Police were at the home at 5:30 a.m. when she returned, he said.

People sometimes have parties at their home but there is never any violence, Uelar said, who added vehicles often come and go from the home after 11 p.m. and midnight.

"It's not loud, just traffic," he said. "We just got use to the cars pulling in and out."

Uelar said he doesn't want to move because he likes his home and just bought an empty lot for a bigger yard, but the slaying has him concerned.

"I know bullets go through houses," he said. "My daughter's bedroom is over there. My bedroom is over there."

Flint, Michigan State Police investigating homicide early Sunday morning on East York Avenue

Published: Sunday, September 16, 2012, 3:34 AM Updated: Sunday, September 16, 2012, 3:43 AM

By Roberto Acosta | racosta1@mlive.com

FLINT, MI -- One man was shot and killed and a woman has been taken to the hospital following the city's latest homicide Sunday morning that occurred on East York Avenue.

Flint Police Chief Alvern Lock confirmed the man was shot and killed around 1 a.m. in the 1000 block of East York, between Selby and North streets.

He was not sure if the woman taken to the hospital had been shot or received another type of injury.

Six police vehicles blocked off the street near the intersection of York and Industrial Avenue, where more than four dozen bullet casings formed a crooked line up and down the street.

Broken pieces of glass also littered the road, and detectives from the Flint Police Department and Michigan State Police searched a car on the street with a broken driver's side window, while a traffic reconstruction team also arrived on the scene.

"They're going to help process the scene," said Lock of the reconstruction team. Family members lined the streets, audibly sobbing, making phone calls, and at one point crossing under the police caution tape to get more information.

No name or age of the victim has been released, and Lock said police have no suspect information at this time.
