Walling needs to read the Economic development Corporation Act, especially the portion referring to projects. as well as the incompatible offices act.

Today with resolution No 100991 Walling asked the council to approve , under the conditions set forth in the American Recovery and Reinvestment Act (ARRA), for bonds totalling $15 million to be issued by the Economic Development Corporation (EDC). Note this was never authorized by the EDC board.

$8.5 million of the city's Recovery Zone facility Bond Volume cap will be for:
(1) financing the cost of designing, acquiring,constructing and equipping an office building and adjacent parking lot for use by the State of Michigan Department of Human Resources , to be leased by the State of Michigan and managed by MIG Investments LLC;
(2) paying capitalized interest, if any, on the bonds proposed to be issued;
(3) paying the costs of credit enhancement, if any;
(4) paying the costs of issuance of bonds.

$6.5 million will finance the Biogas project at the city water plant.

From 1 building to 2 city blocks

The Michigan Department of Human Services office in Inkster became the starting point for a four-building development by Ron Boji that spans two city blocks.
UNDER CONSTRUCTION
The Lansing-based Boji Group'soriginal one-building project in 2008 hasgrown to a four-building development spanning two city blocks with three office buildings and a retail building. It includes:

Michigan Department of Human Services district office

• 32,100 square feet

• Expected completion: Oct. 1

• Retaining 80 jobs in Inkster and adding 49 jobs.

YWCA of Western Wayne County

• 12,500 square feet

• Expected completion: March 2011

• New building allows the group to expand its Head Start program.

Inkster Justice Center: Police department and 22nd District Court

• 45,000 square feet

• Expected completion: March 2012

• Taking the existing YWCA building.

Retail center

• 6,700 square feet

• Expected completion: 2011

After winning the development contract in 2008 to build an office building for the Michigan Department of Human Services in Inkster, Ron Boji started the process of developing one building on Michigan Avenue.

Two years later — through a fortunate chain of events — Boji is preparing construction for the Inkster Marketplace, which has become a four-building development spanning two city blocks with three office buildings and a retail building.

The development fills a vacancy created in the city with the closing of a car dealership in 2002.

“I never would have thought, especially in the environment at the time, that this would come together like it has,” said Boji, president of the Lansing-based Boji Group. “It's been an amazing project, and there was a sense of urgency by everyone involved to see it completed.”

Included in the project is a new district office for the Department of Human Services, a new facility for the YWCA of Western Wayne County, a new Inkster Police Department building combined with the 22nd District Court and a Michigan Secretary of State office next to a restaurant.

The $25 million, 7-acre site, is bringing 92,500 square feet of new building space to Inkster.

To structure the deal, Boji endured two years of tense moments and small victories.

Starting the process was the state of Michigan's decision in 2008 to award Boji the job of developing a new human services building.

During the city's approval process, the city of Inkster urged him to include a retail component in the project, a move to bolster business development on Michigan Avenue.

With no tenants lined up, it was risky.

“But, I thought, we'll fill it,” Boji said.

Later, the YWCA approached him about finding a new building for its Inkster operation — which is next to the east side of the DHS site.

“It was a great idea, but there was no way they could come up with the money for the building,” he said.

Also looking for space at the time was the city's court and police department.

In the development deal that was pulled together, the police and court agreed to leave their current facility across town, then renovate the YWCA building for the new offices.

The YWCA then sold its land and building to the police for $875,000 and received a $750,000 grant. It expects to fill the shortfall on the $2.3 million building with a capital campaign, with Boji fronting it the money in the meantime.

Boji said he was then able to put the secretary of state into the retail space by pointing out the state can save money by being next to the DHS building to use the state's network infrastructure.

With the critical mass of offices, Boji found a restaurateur to sign a lease for the rest of the retail.

Private funding has been arranged by Farmington Hills-based Level One Bank, but the project is heavily supported by public incentives.

The DHS project and the YWCA are receiving $850,000 and $750,000, respectively, in grants through the Neighborhood Stabilization Program of the U.S. Department of Housing and Urban Development.

The two projects also received $1.2 million through Michigan's Brownfield Redevelopment Authority because they are being built on the vacant Rosenau Honda dealership site.

The police and court building is then using $8.5 million in Build America Bonds, a program created as a stimulus for construction in which the federal government subsidizes 35 percent of the interest on the bonds.

The Detroit office of Jones Lang LaSalle represented DHS in the lease, and the Southfield office of CB Richard Ellis represented the secretary of state. Farmington Hills-based GAV & Assoc. is the architect, and Boji Development Inc. is the construction manager.

Inkster City Manager Ann Capela said the project required some heavy lifting by the city as well as Wayne County's economic development team, which secured the NSP money.

Capela said the collective effort of the city and Wayne County was driven by the need to build up Michigan Avenue and restore business to a vacant patch of the city.

“Michigan Avenue is the first thing a visitor sees when they come to Inkster,” she said.

“That had to be our focus. And what we have now is a catalyst for new development in Inkster and a bright spot on Michigan Avenue.”

The Boji Group is putting $4.5 million into updating the landmark Hollister building in Downtown Lansing.

Plans include modernizing the interior and restoring the beautiful 1950s façade. The fifth and sixth floors are being gutted and turned into 25 urban lofts. Construction on the 12-sixth floor units will be complete at the end of the year and ready for leasing by the time Cooley Law School students are finishing their spring semester.

Improvements to the exterior of the building include power washing, tuck pointing and painting. The Boji Group is also adding a limestone finish, new awnings and new Allegan Street entrance to the building.

“This is just another piece of the puzzle that’s falling into wonderful shape,” says developer Ron Boji about the Hollister renovation adding to the new face of Downtown Lansing. “If you look up and down the Washington corridor there’s a lot of stuff happening. The Hollister building change is one of the items that really puts it over the hump. This really makes the revitalization of what’s happening down here a reality.”

Most of the retail space on the first floor is occupied. Jimmy Johns sandwich shop will move into one of the two remaining commercial spaces by the end of the year.

Tax breaks to assist downtown project By Jeremy W. Steele Lansing State Journal Developer Ron Boji is offering a glimpse of his plans to turn downtown Lansing's Hollister Building into a mix of retail, office and residential space. Boji, Mayor Virg Bernero and city economic development officials were scheduled this morning to offer an overview of the project, which will use a series of local, state and federal redevelopment incentives. "This building is a challenge because it's tired," said Boji, whose Boji Group bought the 1893 building about a year ago. "But it has beautiful historical artifacts." The tax breaks range from a local property tax freeze and state business tax credits to state and federal historic tax credits. The city council is scheduled to have a public hearing on a portion of the package July 10. The tax breaks are estimated to save Boji Group $1.4 million in local taxes over 12 years, based on a $4 million increase in the building's value, according to the Lansing Economic Development Corp. Boji envisions the building adding to its retail and office space by putting about 20 apartments on the upper floors. That would give the nearly 100,000-square-foot building about 30,000 square feet of residential space, 15,000 square feet for retailers and 55,000 square feet of offices. Tenants have not been named. That mix has been successful in downtown redevelopment projects in other cities, Bernero said. "It's a major anchor in downtown," he said. "When we talk about a major project and a catalytic project, this is key." The redeveloped building will give the Boji Group three structures along two blocks of Allegan Street. The company owns the adjacent Boji Tower, which leases space for about $20 per square foot, and the new Capital View building, which leases space in the mid- to high $20s per square foot. The Hollister likely will rent in the mid-teens per square foot, Boji said. "It gives me another price point that I can aggressively approach tenants with," he said. Contact Jeremy W. Why isn't this corporation listed on the DLEG website?


The state law says there must be 9 members and no more than 3 can be elected officials. There is specific language regarding Projects that says there must be 2 additional members for each project for as longas the project is ongoing. The law also states the governing body can order the EDC to enter into the bond arrangement. The governing body is defined as the legislative body of the municipality, which is the council. There are other rules and procedures outlined for the initiation of projects.

What this looks like to me is the Mayor sat on this project too long and Flint's credit is in the tank, so he is using the EDC as his vehicle to implement in the 11th hour. Josh Freeman told counil they only had until October 8th to commit to this special bond.
