State trooper shoots man fleeing from traffic stop in Flint

FLINT, Michigan -- A Michigan State Police Trooper shot a suspect after he fled from the scene of a traffic stop around 10 p.m. Saturday on Stewart Avenue near Dupont Street in Flint.
According to police, the suspect was armed with a handgun and tried to exit the vehicle.
The man was treated for a non-life threatening wound and now is in the Genesee County Jail, state police said.
The suspect, whose name was not released, is expected to be arraigned on criminal charges on Monday.

In 1985 there was a U.S. Supreme court case called TennesseeVS Garner. The case was based on a residential burglary in Memphis TN where Memphis police officers shot and killed a 15 year who fled when they responded to a residential burgalry call. The family sued and the case went to the supreme court. The court ruled that officers can only use deadly force on a fleeing person if the officer reasonably believes that the escape of the person would pose the imminent threat of death or serious bodily harm to others. If the fleeing subject in this cae did in fact have a handgun, I would say the trooper had a reasonable belief that he posed a threat of death or serious bodily harm. Based on what is written, it sounds like a justified shoot. |

Oh geesh, now we're worrying about violating the civil rights of criminals. Typical crap that makes Flint what it is today. If the guy was fleeing a traffic stop there was probably justifiable cause to conclude he is a violent criminal. Shoot.....first and fast...or take the chance of that person killing an INNOCENT victim. Easy decision. |
