The discipline angle came in when Marshall testified about how he fell out with the group. Dating Leon Gills sister, he had assaulted her and Gills was angry.

An incident occurred on 2-22-2008 near Howard Estates. Marshall testified Gills was "mugging" him and he pulled out a gun. the shootout occurred later. Each fired over 5 times, but neither was hurt.

A second incident occurred about 2 months later on Howard Avenue by the railroad tracks on the south side of Howard Estates. Marshall was walking towards Howard Estates and Leon Gills and Lil Shawn were walking towards Pingree. Although they did not exchange words they exchanged shots, as many as 20. It is no wonder they did not injure each other at the long distance Marshall indicated they shot from.

Eventually, Gills, Nutty and Marshall all left Howard estates.

More songs. Exhibit #25 was a song remix with Gills and Nutty sang on the original. A second song was played that included lyrics about Howard Estates, Murda Ville is where I hang, and snipe em like a game. There was also references to specific weapons and ammunition.

Marshall placed some songs on Myspace.

The cross examination of Marshall discussed the plea bargain Marshall got in the state case under Prosecutor David Leyton. The case 08--2064 FC reduced an Assault with intent to murder down to Assault with intent to do great bodily harm. There were also charges for Firearm discharged towards a building, weapon -concealed carry and felony firearm. The sentence was for 4 and a half years and Marshall is currently on parole in another jurisdiction.

The prosecution emphasized this conviction and the plea occurred in the state court and not the federal system. He received no threats of federal prosecution during the trial.

The FBI did visit Marshall in Jackson Prison in 2011. At that time there was mention that he was in the Howard Boys, but no threats or mention of racketeering.

While placed on parole last year, Marshall violated by associations with other suspects on facebook and other social media contacts. When he attended his parole meeting on the violation, the FBI were present. This time they told him they had other witnesses placing him at the market robbery and the shootout at the gas station.The agents also inquired about other criminal activity involving the Howard boys

He was violated and sent to the Detroit Reentry Center for the 30 day maximum violation sentence. For the first two weeks, he was on 24 hour lockup. He was released on June 5th.

The two Walker brothers recorded the "I'm from Merrill Hood" cd at Marshall's studio MV HB Entertainment.in his basement. It was intended to show disrespect to the Howard Boys. Both Marshall and J-Nutty worked in night clubs.

Marshall did not record "No bars can stop a legend" but it may have been a promotion for him. Marshal noted that a street cred is not needed, but it helps in music promotion.

During cross examination it came out that Vance sent Marshall a letter offering use immunity meaning that his testimony could be used against him. The defense tried to rattle the witness. Marshall received no money from any federal source while in prison to entice him t testify.

The jury was allowed to ask questions and the Judge read them after conferring with all of the attorneys.

When asked what "murda ville" meant to him, Marshall responded the area.

One of the photos in the exhibit was labeled "Stewart Hood:. Marshall indicated it was the same area as the Howard Boys.

FLINT, MI -- Seven alleged members of a violent Flint gang were arraigned on charges ranging from murder to drug crimes today in Flint District Court.

The seven men are accused of being members of the "Howard Boys" gang, which authorities say used violence to preserve a drug and gun traffic operation on the city's south side for the past decade.
Two more men are still waiting arraignment on state charges and 12 others have been named in a federal indictment in relation to an investigation into the alleged gang by law enforcement.

Those arraigned today by Flint District Judge Nathaniel Perry III include:

•Paki L. Bonner, 32, of Flint, is charged with conspiracy of first-degree premeditated murder, three counts of assault with intent to murder, discharge of a firearm from a vehicle, carrying a concealed weapon and felony firearm for an August 2005 incident involving rival gang the Terrace Boys.

•Taron M. Brown, 21, of Burton, is charged with two counts of delivery or manufacture of less than 50 grams of cocaine, conspiracy to deliver or manufacture less than 50 grams of cocaine, carrying a concealed weapon, possession of a short-barrel shotgun/rifle and felony firearm.


•James Ebert, 23, of Flint, is charged with two counts of conspiracy to deliver or manufacture less than 50 grams of cocaine, delivery or manufacturing less than 50 grams of cocaine, carrying a concealed weapon, possession of a short-barrel shotgun/rifle and felony firearm.


•Rodrick T. Jackson, 26, of Grand Blanc, is charged with conspiracy of first-degree murder, two counts of assault with intent to murder, discharging a weapon from a vehicle, carrying a concealed firearm and felony firearm in relation to an August 2005 incident with rival gang the Terrace Boys.


•Darryl D. Scott, 28, of Flint, is charged with first-degree murder, conspiracy of first-degree murder and assault with intent to murder for a June 2005 incident with rival gang the Terrace Boys.


•Eddie L. Williams, 32, of Flint, is charged with conspiracy of first-degree murder for the July 2004 death of Johnathan Parker. Suspects identified in the federal indictment are also accused in Parker's death.


•Charles T. Orr, 29, of Flint, is charged with conspiracy of delivery of marijuana and delivery of marijuana.

Perry ruled each person held on murder charges with no bond. For the others, Perry issued a bond of $15,000 for each charge.

All eight men are due back in court May 15 for pretrial hearings.


Two of the men charged in the federal indictment were also ordered by Federal District Magistrate Judge Michael Hluchaniuk to be held in custody until their trial.
Hluchaniuk ruled that Jamil Cureton, who was indicted on charges of racketeering and distribution of crack cocaine, posed a risk to the community and should be held in custody.

Prosecutors cited numerous posts and pictures on online social networking sites that allegedly showed Cureton posing with gang signs and referencing violent acts. They also cited a long criminal history of drug charges.

Cureton's attorney, Mark Gatesman, argued against the decision due to his client being employed and is attending school online.

Markus Evans was also ordered to be held in custody, but he did not dispute the decision.

Evans was indicted on charges of racketeering, four counts of distributing a controlled substance, two counts of unlawful transport of a firearm and importing/manufacture of a firearm.
Judith Gracey, Evans' attorney, said her client was already awaiting sentencing for a probation violation and is facing another drug charge in state court, and he was unable to meet the bond obligations.

Note that not all of the men were shown as living in Flint. One Burton and one Grand Blanc. The Walkers started in the north end and then were shown in the court records as living at 1613 Kent by 2oo7. This address is shown as being owned by Faith Gospel Temple of 1525 Kent, Supt. James E Walker Jr..

Remember hearing the expression about attorneys that they should ever ask a question when they don't know the answer. Well that happened during the testimony of Darryl Scott. After conferring with his client, the defense asked Scott if the Hot boys reference was in regards to the group Hot Boys. Scott sat upright and replied he was a "hot boy". A hot boy is one that that does illegal things and is reckless about their behavior even when under surveillance by the police.

One Hot Boys video shows the group in an open convertible being chased by the police. While many groups are not creative in the selection of their names and sometimes pick monikers from music and other themes, there still is a meaning behind their choices.

I would not want to be the federal agent trying to determine if Scott's testimony was truthful. It was hard to tell at times if he truly had no recall or if he was truly devious.. His memory lapses were in stark contrast to the detail and excellent recall he had of matters truly important.

Scott described a March 2011 altercation involving J-Nutty on Dontae (?) . Both j-Nutty and Dude warned Dontae(?) to keep his mouth shut as he talked too much.

Scott started selling drugs at age 15 when he lived at 701 Lippincott in the Stewart Hood. At that time the group used the name of the school as an identifier for the area. He and his brother later moved their drug sales to the 7th street area , a 20 minute walk. He bought the supplies and made his own rocks. Then (1999) no one needed any permission to sell drug.

Tattoos of Hot Boys and Get Money. Began hearing of Murda Ville around 2006. He also hung out with people in Atherton Terrace.

In June of 2005 Cheeks called him to go to Atherton Terrace to shoot someone. Scott drove. They had 2 guns but he doesn't know which one killed the victim.

The next day he was in a car with 2 Burton detectives and he met with Genesee County Prosecutors the day after. Defense alleged Scott tried to sell information on the shooting for $1200, which Scott denied.

He was in prison in April of 2013 when the FBI visited. They had previously seen Jonathan Walker, so he was not surprised. His attorney, Wolf, told him he was F**ked as there was no statute of limitations on murder. He was told if he testified truthfully, his statements in court would not be used against him. He was among a number of Howard Boys being held in the Sandusky jail.

Scott testified that Gills was a talented rapper and Gills performed in concerts. Scott named Purple Moon, Palm Tree and Arlene's as local places Gllls had performed his rap.
He was asked if his tattoo of Hot Boy was because he was a follower of the rap group from 2001 to 2005. He testily stated no-"I am a Hot Boy". The defense had no follow up.

$5 off the $20-Scotts response to what this meant was that when he had a sale and he had no dope. he could then go to another dealer and make an arrangement to get $5 off the sale.

The murder of Marion Anthony Hardy is a part of the RICO case.
Tried in the Genesee County Courts, the murder charges were reduced to manslaughter by the Prosecution.

Case 07-219505 FC

At the Preliminary hearing before Judge Perry, Zimmer, the attorney for Jonathan Walker, was furious with Sheriff Pickell. The Sheriff Department had transferred Walker to the Oakland County Jail where he was being held in 23 hour solitary. APA Hanson stated the Prosecutors office had no control over where the Sheriff transferred prisoners.

On August 1, 2006 Hardy was shot six times in Howard Estates.

The primary witness was Michael Cornell Brown. Brown testified he moved out of Flint, but returned at the request of his former girlfriend to help Hardy. He said Hardy was being stalked and he was to try to smooth things over.

He, his former girlfriend, Hardy "Gangster Boo" . someone he knew by Vernon and Vernon's girl friend waited until about midnight and started to walk to the "baby mother" of Hardy's. Brown, a cocaine dealer, stopped to sell some dirt, a $10 crack rock, to someone he only knew as "Blue".

Brown testified he saw Jatimothy and Jonathan Walker run from behind a building and confront Hardy. Hardy removed his jersey and squared off to fight when Jatimothy pulled a weapon. Hardy. whom Brown indicated had been drinking, began to verbally berate the Walker's. Jatimothy allegedly shot Hardy first followed by Jonathan with a total of six shots.

Brown testified that someone he knew as Shawn John, like P Diddy, (Sean Cunningham) rushed in and started to kick Hardy in the head.

Both Walker Brothers came up with alibi defenses. The testimony of Brown was challenged by the defense. Once the shooting started Gangster Boo and Blue, aka Smurf, both ran off. Most of Jonathan's alibi witnesses were from Texas and were unable to be located.

Brown left the scene before the police arrived because he was on probation and had been in Howard Estates much of the evening selling crack. His ex-girlfriend finally persuaded Brown to come forward to meet with the police.

Brown testified he left Flint in February of 2006 and came that night to meet Jatimothy (JT) Walker on behalf of Hardy. He had not seen JT earlier that day. He testified he knew both walkers and saw Jonathon frequently walking through the Estates. Jonathan, Brown said, was usually at the 12th Street market.

Brown testified that the Walker's ran to the home of a lady and her son drove them away. Citing prosecution problem. the brothers were allowed to plead to manslaughter and served a year in jail.

The father of Marion Hardy lamented his son had not received justice and was upset that after shooting his son the Walkers only got a year in jail. The father stated his son was from California and "they just didn't like him".

Jonathan Walker was also implicated in the provision of a weapon in the homicide at Lapeer Gardens (2324 Lapeer) in October 2010.

Testimony from Flint Police Sgt. Cynthia Herfert stated she received a cell call from a Confidential Informant regarding a tip that there were 2 men in maroon Crown Vic with a gun while drinking and doing drugs in front of 2714 Brown. She was joined by Sgt. Terry Coon and later by Lt. Mahan.

Herfert testified she approached the vehicle and asked if they had been drinking. Walker told her they were drinking Hennessy. The passenger, Dudley, was arrested for open warrants. Walker denied permission to search the car and said it belonged to his mother. Herfert obtained a search warrant and found two weapons inside a blue backpack in the trunk. One was a 380 with 5 rounds in the magazine and 1 in the chamber. The Barretta 9 millimeter had an extended clip that held 30 rounds.

Herfert also testified that Walker told her he obtained the 380 from an individual in the north end and had planned to sell it. The individual selling the first gun referred Walker to someone on the east side for the second gun. He got the gun the day of the homicide and gave it to someone who allegedly needed protection. This individual was the homicide suspect and they returned the weapon to Walker after the homicide.

This case was not prosecuted "pursuant to the defendants federal indictment on the same complaint"

Jury Intimidation?

John Minock, the Ann Arbor based defense attorney for Johnathan Oldham, filed a second motion for a mistrial on June 17, 2014.

1. Today the Court and parties became aware that third parties the jurors believe are affiliated with unspecified Defendants have engaged in improper contact with the jurors. following them home from court and attempting to identify their vehicles and their license plate numbers.

2. This improper third party conduct has seriously intimidated virtually the whole jury.
