In the initial resolution #100050, dated January 25,2010, it discusses how the original proposal from Operation Unification was to develop seven (7) homes in an area 1 as set forth in the request for proposals and approved by HUD under the NSP plan.

It was the City of Flint that requested Operation Unification modify their proposal to rehab up to 10 houses in area 3, an area bounded by N. Saginaw on the east, E Russell Street and W. Russell Street on the south, and Carpenter Road on the north.

Information I have received indicates it was Tracy Atkinson that insisted on this modification over protests from staff in DCED. The houses selected correspond to the area in the Master Plan for the northwest quadrant of the city. Vernon Chapel is located on Dupont.

Included in the lawsuit is a Narrative Description.

"* Operation Unification , a 501C CHDO (certified in Genesee Count and Flint) proposes to rehabilitate ten (10) abandoned and foreclosed home properties in the Area 3 section of Flint, Michigan, located in Area 3 compromised of Census Tract 2 and is located in the Northern most portion of the Renewal Community."

(Misspellings are by the author of the document)

My issue with this statement is I do not agree that Operation Unification met the criteria of a CHDO (Community Housing Development Organization.

Operation Unification used a Board of Directors from Detroit on their 990 statements to the IRS. Their Michigan nonprofit Board was an interlocking directorate between the non profit and for profit units comprising Operation Unification. In other words the for profits and non profits had the same board and conducted their business together. It is my belief and understanding this is not allowed per the IRS rules on nonprofits.

In the past the City of Flint required annual audits for entities receiving federal funds over a designated limit. They at least required an annual IRS statement of 990 as required by the IRS. Both the agency and the principal officers should have been checked for delinquencies.

It did not appear to me that the county followed any rules.

Had the City checked under the name Charles Young Jr. they would have seen that he was 2 years behind in property tax payments for the land in Beecher (Genesee Township and Mt Morris Township) and one parcel in Flint. This information was vital to the determination that he was a good credit risk. Since the Genesee County Land Bank was a partner with Flint and Genesee County under the NSP2 program that came through the state MSHDA, this information about his money woes should have been known.

I would investigate if individuals in the Genesee County government and within the Genesee County land bank were complicit in allowing the involvement of contractual agreements between Young, Operation Unification and the county as well as the Land bank.

The county Metropolitan Planning Commission entered into a $500,000 contract with Operation Unification just a month before a number of properties went into forfeiture. That means the records should have shown Operation Unification and Charles Young were one to two years behind in taxes on some of their properties. Someone was seriously negligent in allowing this contract.

Why was this presented to the County Commissioners as legitimate? Why didn't this information come out to the Flint City Council? If officials in these two bodies knew about the issues, why did they stay quiet?

Is Young preparing to muddy up the waters by exposing governmental corruption?

I can't wait to see how this plays out.

I believe the authorities need to ask whether Greg Eason or Dayne Walling are implicated in this seemingly fraudulent contractual arrangement. They were at the top when many of these early decisions were made.

A document included in the City of Flint lawsuit appears to be a page from the documents presented to HUD.

In reality this rhetoric says nothing. But it does indicate the author is aware of at least some of the for profit components of Operation Unification.

The land bank is attempting to help sell some of these properties and the price has been reduced for some. There was a provision that 50% of the homes were to be sold to households that were low income. It also claimed that no other funds were necessary to fund these homes as leveraged resources would be provided by OU and its Community Partners.

Nonprofits housing 501(C)3's are expected to be able to leverage funding to assist with development by partnering with other groups and using grant funds to supplement the federal funding. The federal monies do not pay for all nonprofit expenses.

However, with Operation Unification the for profit components were in financial trouble and at times had tax liens and other issues.

The City of Flint and Genesee County entered into contractual relationships with the Village café for food services in their cafeterias. Were city and county officials aware of the agencies financial problems or were these contracts bid properly?

Is there any way the City of Flint can find any resources to repay them for the NSP snafu? The City has had to use other funding to bring the houses up to standards.

Phillip Johnson of EMAR is said to be an excellent contractor. However, I believe he is the husband of Operation Unification officer Lela Johnson. If so were certain federal Conflict of Interest requirements met?

The 901 Lippincott is the address of the meat market that the Flint Economic Development Corporation issued a $100,000 loan to Charles and Phyllis Young. So why was the ownership changed within days of one another about the time of the loan? OU Home has been dissolved.

If I remember correctly the 5423 Fairhaven LLC was one of the properties cited in the Steinberg lawsuit where Steinberg alleged corporation assets of the Detroit based SDE were diverted into Genesee county LLCs .

How far up does the corruption go?

The HUD OIG was given all of the earlier documentation and she chose to do nothing. Who was powerful enough to influence her or was she incapable of understanding. I could not believe that she blew off the allegation that Charles Young and Operation Unification lied and misrepresented the agency in their applications for federal funding. It is a felony and is being prosecuted in many cases in all states.

Who influenced Flint and county officials to ignore flagrant violations of procurement. Perhaps they too are incompetent?

Years ago when I and others were investigating another administration, a top HUD official blamed Washington for their inability to effect change and prevent corruption.
