Members of the new Black Panther Party, Olajuwon Ali aka Olajuwon Davis and Brandon Muhammad aka Orlando Baldwin have been indicted on weapons charges in federal court for allegedly attempting to make straw purchases of two handguns at the Cabela’s sporting goods store in Hazelwood, Missouri. The indictment outlines how the men purportedly lied on forms submitted during the purchase, claiming to be buying two Hi-Point .45 ACP pistols for themselves when they were actually acting as a straw purchasers for someone else. The indictment doesn’t identify the intended recipient of the handguns.

Citing an anonymous police source, the St. Louis Post Dispatch reported that a months-long investigation uncovered their plans to acquire weapons, “to do harm to law enforcement and the public.” Yet other news media, including Reuters and ABC, cite their own anonymous sources to report that the FBI arrested Baldwin and Davis for allegedly planning pipe bomb attacks to take place during future Ferguson protests. KMOV also mentions the alleged pipe bomb plot, but its report doesn’t make an explicit connection to the men.

Interestingly, CBS News scrapped its initial story on the arrest — “FBI arrest 2 men for buying explosives near Ferguson.” That headline was later changed to “FBI arrests 2 men on firearms charges near Ferguson” and mentions of explosives were removed from the story. (Briefly, the story included a formal retraction.)

The CBS story was revised yet again early Saturday morning, and it currently cites a “law enforcement source” to corroborate allegations that the duo purchased explosives.

However, as IJ Review has reported, the New Black Panthers aren’t the only antagonizers in Ferguson. In August, we profiled a communist agitator who was trying to provoke a confrontation with police. The KKK has also been threatening to cause violence as well.

In a statement posted to Facebook, the National Central Committee of the NBPP showed their support for Olajuwon Ali, Brandon Muhammad:

NBPP OFFICIAL STATEMENT: ON OLAJUWON ALI AND BRANDON MUHAMMAD CHARGES AND ARREST
It’s being widely reported via right-wing Internet sources, that allegedly members of the St. Louis chapter of the New Black Panther Party, Olajuwon Ali and Brandon Baldwin were arraigned on Federal charges in the court of US Magistrate Tom Mummert for trying to purchase pipe bombs.

According to our reports this allegation is a complete BOLD FACED LIE and FRAME UP attempt toward the local St. Louis organization and membership, in an effort to stop the organizing capability of the local party, under false pretenses of “Straw Purchases”. Reports direct from the court proceedings reported the charges listed as alleged, ‘ intent to purchase a firearm under fraudulent circumstances
also known as making straw purchases of two handguns, which if proven guilty is a federal crime. Alcohol can also be a straw purchase when,” in most jurisdictions when a person under the legal drinking age requests that a person above the legal age purchase alcohol for the underage person, and the straw purchaser knows or might reasonably assume based on the circumstances that the person is under the legal age.”
This is defined as a firearms purchase where a straw purchaser of a firearm willfully lies about the identity of the ultimate possessor of the gun, and is charged with making false statements.

Also, mortgage loans when straw buyers, in exchange for a cash payment apply for mortgage loans on behalf of other parties; and knew before submission of the application that the loan would not be paid as agreed.

It has not been proven, that Olajuwon Ali ( s/n Davis) or Brandon Muhammad ( s/n Baldwin), had any intent to be deceptive in regards to where the firearm was going or who it was going to. Olajuwon Ali and Brandon Muhammad were reportedly attempting to make a purchase of a legal firearm at a reputable dealership. It is also notable, that Olajuwon Ali, is a member of the Moorish Science Temple of America and defines his Nationality, as a Moorish American.

The allegations that the two were in, ” preparations to destroy the arch by blowing it up as a sign of white racial oppression as well as killing as many cops as they could during the impending unrest in Ferguson after the grand jury decision is announced” we believe is TOTALLY UNFOUNDED, and is against the rules and regulations of the New Black Panther Party.

The New Black Panther Party, does not teach, endorse, or allow its members to commit acts of violence against anyone regardless to the circumstance unless in imminent danger and in Self- Defense.

We do not condone aggression in deed or action! The men accused are innocent until proven guilty, and no matter what must be handled as such- until the facts are presented.

We believe the reports of an alleged confession/s to any illegal action are baseless and have no merit. False reports spreading online or via media, only serve to confuse the issue and heighten an already tense situation in Ferguson, MO.

We make clear the New Black Panther Party, does not condone and distances itself from all illegal actions or acts of terror aimed at coercing individuals through violent means; for political reasons or otherwise!

We defend Olajuwon Ali and Brandon Muhammad’s right to a fair trial; as defined by the Bill of Rights in the sixth amendment of the United States. We say they must be judged by a jury of their peer group and the facts weighed evenly without slant or bias.

If it is true that Olajuwon Ali , or any member of the New Black Panther Party, is guilty of illegal acts and has violated the rules of our Party; he/she will be expelled from our ranks and membership terminated into perpetuity.

We believe that the charges against Olajuwon Ali and Brandon Muhammad to be trumped up and baseless; and believe that the two men will be cleared/vindicated of any alleged wrong doing.

Feds: Fez-wearing drug dealers deserve life in prison

Robert Snell, The Detroit News 9:54 p.m. EDT October 14, 2014

Detroit — Two fez-wearing drug dealers who fled ahead of guilty verdicts should be sentenced Friday to life in prison for running one of Metro Detroit's largest and most lucrative drug rings, prosecutors said.

In urging U.S. District Judge Stephen Murphy to send drug kingpin Carlos Powell of Washington Township and brother Eric Powell of Franklin to life behind bars, prosecutors offered new details on how the men were captured in June following a nationwide manhunt.

The manhunt and case drew national attention because of the size and scope of the drug ring and because the brothers and fellow drug dealer Earnest Proge of Detroit wore fezzes to court every day. The men said they were members of the Moorish Science Temple of America but a temple leader said the fezzes were a failed attempt to influence jurors.

The sentencing is scheduled five months after the men enraged Murphy by fleeing just before the jury in their drug trial announced guilty verdicts.

"For years, Carlos and Eric Powell ran a multi-million dollar drug trafficking operation, importing staggering amounts of drugs — including hundreds (if not thousands) of kilograms of heroin, some of which was over 90% pure," Assistant U.S. Attorney Steven Cares wrote in a sentencing memo late Monday. "Their illegal drug business caused immeasurable blight and decay in this city and region."

Life in prison is justified, he argued, because Carlos Powell was involved in selling more than 1.1 million kilograms of marijuana. The weed weighed as much as 1,000 automobiles, he said.

Carlos Powell should receive a 15-year sentence, defense lawyer Deday LaRene wrote.

Such a sentence and probation "would allow for the possibility that Mr. Powell could have some hope for a meaningful life after prison, and would be an appropriate exercise of the court's sentencing discretion," LaRene wrote.

Eric Powell, meanwhile, should go to prison for less than 30 years, his lawyer Domnick Sorise wrote Tuesday.

The government's filing provides new details about the Powell brothers' weeks-long escape in May.

When Carlos Powell learned there was a verdict May 12 that could lead to life in prison, court officials said he cut his ankle tether and disappeared. The ankle tether was found blocks from federal court in downtown Detroit.

Federal agents learned the same day that Eric Powell and Proge had disappeared, too.

Carlos Powell was captured in a home in St. Louis, Mo., on June 4. He had more than $750,000 in cash on him and numerous cellphones, Cares wrote.

Eric Powell was arrested by a fugitive task force at a hotel in Atlanta, Ga., the same night as his brother. He was carrying more than $50,000 cash and a fake birth certificate, the prosecutors wrote Monday.

Proge was arrested June 18 in St. Louis. He will be sentenced Dec. 5.

The Powell brothers and Proge were able to flee because they were released on bond in 2012 despite a history of running from police, violating probation or committing crimes while free on bond. Federal prosecutors did not ask a judge to jail Carlos Powell or request temporary detention.

New reports shed light on Ferguson assassination plot

Thursday morning, St. Louis Post-Dispatch released a report that two men were arrested for attempting to assassinate Ferguson Police Chief Tom Jackson and the local prosecutor. Jackson spoke to NBC News telling them he was warned about a plot but did not know the details and this was not the first threat against his life. The two men charged are Orlando Baldwin and Olajuwon Ali Davis; they were indicted last week on weapons charges and are expected to be charged for the recently detailed plot. They were placed under surveillance after officials learned of the plan to buy guns and explosives to make pipe bombs, two federal officials told NBC News.

The two men attempted to purchase what they believed was a pipe bomb during a law enforcement sting. The men wanted to acquire two more bombs but could not afford to do it until one suspect’s girlfriend’s Electronic Benefit Transfer card was replenished. Baldwin and Davis pleaded not guilty in a hearing Tuesday. At a second hearing, prosecutors were prepared to argue that both should be held in jail until trial. An FBI agent was present, and photographic or video evidence was ready to play. But both defendants waived their right to make a case for bail, so the hearing did not proceed. The Post did not know if the men planned to use the bombs to kill both the Police Chief and the Prosecuting Attorney.

This arrest comes just three days before Ferguson police Officer Darren Wilson would not be indicted in the fatal shooting of Michael Brown. Federal authorities said the suspects did not appear to be a serious threat or part of a larger operation. Davis’s family said this case is on “Lies, lies and more lies.” Both suspects refused to comment. Police have continued to guarding McCulloch and Jackson’s homes in the wake of the continued riots.

Alleged plot included bombing Arch, killing St. Louis County prosecutor, Ferguson chief

November 27, 2014 8:15 am • By Christine Byers cbyers@post-dispatch.com 314-340-8087 and and Robert Patrick rpatrick@post-dispatch.com 314-621-5154

ST. LOUIS • Two men indicted last week on federal weapons charges allegedly had plans to bomb the Gateway Arch — and to kill St. Louis County Prosecuting Attorney Robert McCulloch and Ferguson Police Chief Tom Jackson — the Post-Dispatch has learned.

Sources close to the investigation were uncertain whether the men had the capability to carry out the plans, although the two allegedly did buy what they thought was a pipe bomb in an undercover law enforcement sting.

The men wanted to acquire two more bombs, the sources said, but could not afford to do it until one suspect’s girlfriend’s Electronic Benefit Transfer card was replenished.

An indictment, with no mention of bombs or killings, was returned in federal court here Nov. 19 and unsealed Friday upon the arrest of Brandon Orlando Baldwin and Olajuwon Ali Davis. Their addresses and Baldwin’s age were not available; Davis is 22.

The arrest came three days before McCulloch revealed that a grand jury would not indict Ferguson police Officer Darren Wilson in the controversial killing of Michael Brown. The announcement triggered looting and multiple arsons in Ferguson.

The charges say that between Nov. 1 and Nov. 13, at the Cabela’s store in Hazelwood, Baldwin claimed to be buying two Hi-Point .45-caliber pistols for himself when they were really for another person. Brandon also is known as Brandon Muhammad, according to court documents, and Davis now goes by the last name Ali, his attorney said. Each faces a charge of aiding and abetting the making of a false written statement made in connection with a firearms purchase.

The sources said additional charges, reflecting the plot, were expected to be filed. They said Davis was considered the leader of the plot, which police documented on hidden video.

The firearm charges and arrests were reported by the Post-Dispatch on Friday night. Some national news outlets reported, with no detail, that there had been a bomb plot.

One of the defendants’ plans, the sources said, included planting a bomb inside the observation deck at the top of the Arch. It was not clear how they could have gotten a bomb past airport-style security screening for rides up.

It also wasn’t clear, the sources said, whether the men intended to use bombs as the means to kill McCulloch and Jackson. Both officials became targets of national criticism and protests after Brown’s killing.

Local and federal authorities have served search warrants at two buildings, one in the 2500 block of Hampton Avenue in St. Louis and the other in the 1500 block of Reale Avenue in north St. Louis County, but the associated documents were sealed.

Bill Woods, special agent in charge of the FBI office in St. Louis, peeked into court at one point, but there were no available seats. The room was full with family and supporters of Davis and Baldwin.

After the hearing, prosecutors referred a reporter to U.S. Attorney Richard Callahan, who referred questions to Marc Raimondi, spokesman for the Justice Department’s National Security Division. Raimondi declined to comment on “anything beyond what was in the public document available through the court.”

Asked for comment after the hearing, a female relative of Davis, who refused to give her name, said the case consisted of “Lies, lies and more lies.”

Davis’ attorney, John Lynch, said that he had waived the detention hearing because, “This particular case involves serious issues, especially in light of the Ferguson matter. My client is entitled to a patient analysis and due process like anybody else, and he looks forward to a vigorous defense.”

Lynch said that Davis was “particularly bright” and had been associated with the Young Artists for Justice and Peace, which works to take back streets from drug dealers. He said prosecutors were accusing Davis of a “pretty serious” gun charge, “with other charges potentially looming in the distance.”

Davis and his wife were expecting a child Dec. 5, but the child was born over the weekend, after she fainted at another court appearance Friday.

Baldwin’s public defender declined to comment, as did relatives of Baldwin contacted by a reporter. He appeared in court in a neck brace, reportedly because of a car accident.

Law enforcement sources and neighbors of McCulloch and Jackson said police had been closely guarding both their homes.

Davis spoke at a New Black Panther rally at Greater St. Mark Family Church in Ferguson last month about the police shooting of Brown, and was identified there as the Missouri chapter’s “minister of law.”

“This is not the first Mike Brown, and it won’t be the last, if we do not unite,” Davis told the crowd then. “Divided, we lose brothers and sisters. If you do not unite, put aside your difference and unite, you can expect no changes in the future. We must change our minds, our systems and ourselves.”

The New Black Panthers has issued a statement calling the allegations regarding bombing and killing “totally unfounded” and “trumped up and baseless.”

The statement also says that the New Black Panthers do “not teach, endorse, or allow its members to commit acts of violence against anyone regardless to the circumstance, unless in imminent danger according to the rules of Self-Defense.”

Davis also is a self-proclaimed “Moorish-American,” and in a YouTube video posted last year invited viewers to learn how to avoid taxes and unconstitutional laws.

He also said in the video that he was hit with a Taser and arrested by St. Louis police in 2013 after he tried to make a purchase without paying taxes at a St. Louis gas station. He said the clerk “denied me of my right not to be taxed as a Moorish national” and refused to accept his identification.

In July 2010, the Post-Dispatch photographed Davis as a recipient of an Access MO award letter for $1,510 to attend the University of Missouri-Kansas City, where he was planning to study economics. The story noted how budget cuts had threatened to slash the amount of financial aid students across Missouri receive. At the time, Davis told the newspaper that he would be the first member of his family to attend college.

Valerie Schremp Hahn of the Post-Dispatch contributed to this report.
