China has accused followers of Tibet's exiled spiritual leader, the Dalai Lama, of masterminding the rioting, which has scarred its image of national harmony in the build-up to the Beijing Olympics. [w[

HUMAN RIGHTS , SERIOUS OR ACTING

I think there are real human rights violations in China. Enough to stop an Olympics? With all this country is doing we would be hypocrites.[trb[

Bystanders cheered the group Tuesday as they walked along the mountain roads. Police were not around.[afp]

A simple act of defiance by an oppressed people.[trb]

Tibetan monks have defied Chinese authorities by staging a protest in the remote Himalayan region's capital Lhasa, provoking Beijing to respond that it would strike hard against such illegal activities.[g]

The International Campaign for Tibet cited unconfirmed reports of scores of Tibetans killed. John Ackerly of the group said in an e-mailed statement he feared "hundreds of Tibetans have been arrested and are being interrogated and tortured." [w[

China still practices summary execution.[trb]

Violent protests in the Tibetan capital Lhasa against Chinese rule have left at least 100 people dead, according to unconfirmed reports from exiles in India, while official media put the death toll at 10.[c[

China set a "surrender" deadline after riots in Lhasa that it said killed 10 innocent people, launching a crackdown on Saturday after the worst unrest in Tibet for two decades. [w[

A WORTHY ISSUE BUT SUBSTANDARD SPOKESPERSON

China should suffer a boycott of its cherished Beijing Olympics if it mishandles protests in restive Tibet, Hollywood actor and Tibetan activist Richard Gere said on Friday.[r[Well lets set international policy on the word of another actor.[trb[

"The victims are all innocent civilians, and they have been burnt to death," an official with the regional government told Xinhua.[c[

Gere, a close follower of the Dalai Lama and chairman of the International Campaign for Tibet, stressed that neither the exiled Tibetan spiritual leader nor the ICT advocates a boycott of the Summer Olympics.[r[ Then pray tell from what authority is he.[trb[......

It would be unconscionable to isolate America fro the game under this ruse. Dose it not seem hypocritical for a US patriot like Gere to mouth this while our government violate human rights daily in military prison.[trb[

Indian police surrounded the Tibetan community in old Delhi Friday, effectively sealing it to prevent anyone from going in or out after a Friday night protest, a spokesman for the Tibetan Youth Congress told CNN.[c

"I've not been pro-boycott, but I think if this is not handled correctly, yes we should boycott. Everyone should boycott," Gere told Reuters in a telephone interview.[r[ I begin by calling for a boycott of Gere and his empty rhetoric.[trb[

Gere, a Buddhist for some 25 years, said he was grieving for "my bothers and sisters" in Tibet but "sad for both sides" in a dispute has that simmered and occasionally exploded since China annexed Tibet in 1950.[r[Another Hollywood nut job.[trb[

Following are a couple of articles of the type that make us look foolish to the world.[trb[

FLINT IN THE NEWS -EXECUTIVE DEPARTMENTS , PASTORS AND GOOD GOVERNMENT

FIRE CHIEF

An investigation into the multimillion-dollar Career Alliance Inc. has been taken by agents of the U.S. Department of Labor, The Flint Journal has learned.[f1[ Flint is strutting its stuff again.[trb[
Labor Department agents will present their findings in pieces or in whole to the U.S. attorney's office in advance of criminal charges -- if they are filed. [f1[

Meanwhile, Flint's fire chief and his son, a city police inspector, have hired one of the area's leading criminal attorneys to defend them against possible charges stemming from their private security company's dealings with Career Alliance.[f1[

City Security Guard Co., which has provided security at Career Alliance buildings, lists Fire Chief Richard Dicks as its president and treasurer in documents filed with the state. [f1[

Federal agents last month searched the homes of Dicks and his son, David, a Flint police inspector, looking for records related to Career Alliance. Richard Dicks' home in Genesee Township is the main office for City Security Guard [f1[

Frank Manley, a well-known criminal attorney, said he has talked briefly with federal officials, telling them he has been hired to defend the Dicks.[f1[ Keep your money in the community.[trb[

The Flint Journal could not reach the U.S. attorney's office for comment Thursday or Friday.

Career Alliance is a $20-million-a-year agency that provides job training and education to the poor and unemployed.[f1[

PASTORS

"When it comes to right and wrong, you want to stand up for what's just ... (but also) life is about forgiveness," said the Rev. Quintin Marshall Sr., pastor of New Life Tabernacle C.O.G.I.C. in Flint. "Who do you find who doesn't have a (crease) in their armor?" [f1[

Marshall, president of Genesee County Church of God in Christ Alliance, supports a group that has been working to keep Career Alliance's Broome Center open despite a high vacancy rate there.[f1[

"We got people who are homeless and need a job (and) leaving prison and can't find work," Marshall said. "Let's work on these problems."[f1[

CITY ATTORNEY

Leading African-American pastors have a message for City Attorney
Trachelle Young and City Clerk Inez Brown: Cooperate and make peace.[F2[
The ministers gathered at Antioch Missionary Baptist Church to make a public plea for two of the city's most powerful women to settle an increasingly bitter dispute.[F2[

Last month Young filed a lawsuit against Brown on behalf of the city for her refusal to call a meeting of the Standards of Conduct Board concerning a complaint about her actions toward another city employee.[F2[

The seven-member conduct board looks into the actions of elected city officers, appointees and employees.[F2[ Wrong[trb

"We're asking City Attorney Trachelle Young to drop the charges and the lawsuit against Ms. Inez Brown and we're asking the clerk to turn over and give to (City Administrator) Darryl E. Buchanan the list of names of the Standards of Conduct Board," said the Rev. Lewis A. Randolph.[F2[ What does Buchanan have to do with this[trb

"We all agree this in-house fighting at city hall has to stop," Randolph continued. "It's time for dialogue and not debate. We are speaking from a point of healing and from a point of righteousness. We're trying to stand up and say let's come together as a family."[F2[ Young needs only to withdraw her frivolous lawsuit[trb[

AND MORE PASTORS

Besides Randolph, the group included other notable pastors such as Bishop Otis Floyd, Bishop Rory Cavette, Bishop M.C. Akins, and the Revs. Roosevelt Deloach and Leroy Shelton. The group said they were acting out of concern about the message the legal fight would send to area youth.[F2[

"It's a no-win situation and it projects a bad image to our young people," said Shelton, of Christ Fellowship Missionary Baptist Church. "We have come too far as a community and we have to find a common ground."[F2[ Young started it and Young can stop it.[trb[

Young attended the news conference and said she supports the pastors' stance.[F2[ They are simply trying to save ....her.[trb[

"I absolutely agree with their message," Young said following the event. "This has been blown out of proportion. The problem is an unwillingness to communicate. I'm not anti-Brown or pro-administration. I'm advocating for an employee."[F2[ Nonsense[trb[

Brown said she spoke to Randolph about the matter this week but was not told about the news conference. She declined comment on the ongoing legal battle or the news conference.[F2[ Class.[trb[

City Administrator Darryl Buchanan said he was on hand representing Mayor Don Williamson, who also has battled with Brown in the past.[F2[ Nothing else to do?[trb

"Clergy has always been in the forefront on issues viewed as divisive," Buchanan said. "The mayor is grateful for their involvement to assist with a resolution. ... He wanted me to keep my thumb on the pulse of this situation."[F2[ Words 37 SUBSTANCE 0[trb[

BOYCOTT OLYMPICS!...IT’S STARTING
Tibet group: Prince to boycott Games - CNN.com
http://www.cnn.com/2008/WORLD/...
Britain's Prince Charles will not attend the opening ceremonies of the 2008 Olympic Games in Beijing -- and a group that campaigns against China's human rights record said Monday that the future monarch's decision was in solidarity with its aims.[S]

THERE IS A STRONG HISTORY OF POLITICAL ACTION AT THE OLYMPICS

Human rights groups have in recent months urged the IOC and governments to act tough on the issue towards China. The incidents in Tibet may lead to boycott calls. [e]

Hundreds of Tibetans inside Tibet have carried out protest demonstrations over the past two days, marking the 49th anniversary of the Tibetan National Uprising. Protests of this scale are rare inside Tibet because of the absolute lack of political space. ...

WHAT HAPPENED IN 1980

1984 OLYMPICS
1959 UPRISING
WHY ARE THESE PEOPLE SO UPSET

( a Face Book Poster wrote)Rev. Mitchell, who was not very familiar with the Tibetan situation at the time, asked me for more information.[s2]

SUBJUGATION OF PEOPLE OF COLOR

I provided it, stressing among other factors, the racist nature of the Chinese rule, which involves the subjugation of an ethnically and culturally distinct dark-complexioned people by a light-skinned oppressor. Many people see the Tibetans only as Asians and do not know that they qualify as “people of color.” Indeed I’ve seen photographs of Tibetan nomads, who spend a lot of time in the Himalayan sun, who are darker than many African-Americans. Many people have swallowed the imperialist and Maoist fiction that the Tibetans are Chinese. In fact, there is literature that shows that what is now Tibet existed before China.[S2]

TIBETANS ARE NOT CHINESE

And what may be the most spiritually and politically explosive cultural reality derives from the fact that the Tibetan language is in no way related to the Chinese languages. Tibetan is derived from Aramaic, the language of Jesus. And if you read a paperback by Elizabeth Clare Prophet called “The Lost Years of Jesus”, chronicling the approximately 18 years of His earthly life not accounted for in the Bible, and you read UP FRONT News, it emerges that it was Jesus who brought Aramaic to Tibet.[S2]

As I see it, the fact that Tibet is perhaps the world’s only pacifist nation, led by a monk who preaches non-violence, accurately described as both “the roof of the world” and “the most religious country in the world”, is no accident, considering Who lived there. My own view, unsubstantiated by available writings, is that there is a genealogical relationship between Jesus and the Tibetans, most directly with the Dalai Lamas.[S2]

ATTACK ON TIBETIANS IS AN ATTACK ON CHRISTIANITY

As far as I am concerned, the Chinese Communist attempt to destroy Tibet is essentially an attempt to kill Jesus – again. It was Mao who during his meeting with the Dalai Lama in 1954 told the Tibetan leader that “religion is poison.” And that was because the pathologically megalomaniacal and racist Mao considered himself to be God.[S2]

CHINESE GENOCIDE

In a 1993 interview with me for an article that I was writing for Downtown Magazine (no longer published) Rev. Mitchell labeled the Chinese Occupation as “Genocide” and characterized Chinese actions as “an attack on people who live their faith.”[S2]

DARFUR, TIBET WHATS THE DIFFERENCE?

Many black leaders have spoken eloquently about the Genocide in Darfur. It is a fact that Communist China, in its lust for Sudanese oil, is aiding and abetting the Sudanese government’s complicity in the Genocide. Presidential candidate Bill Richardson during a candidates debate, citing Darfur, suggested that the 2008 Olympic games should be pulled from China. John Edwards, in a talk at Strata in NYC on June 22, voiced his agreement with me that “moral leadership” requires opposition to the Genocide not only in Darfur but also in Tibet. His comment of course went unreported in the mainstream media. I had a chance to talk for a few minutes about Tibet directly recently with Barack Obama’s wife Michelle at her talk in Harlem who, with State Senator Bill Perkins standing next to us, listened carefully and took some UP FRONT News articles to show her husband.[S2]

I’ve spoken with and given UP FRONT News articles on Tibet to, among others, Rev. Al Sharpton and City Councilman Charles Barron.[S2]

HUMAN RIGHTS VIOLATIONS OR A KILLING MACHINE?
AND CONDY SAYS......
THOSE MONKS AGAIN
VESTED INTERESTS SAY NO TO BOYCOTT
CHINA SAYS..HOW IS OUR PR WORKING?
AUSSIES LEAD THE WORLD...
MILD, MILK TOAST , OF NO CONSEQUENCE HOPES CHINA...
SO JUST HOW IS OUT OF CONTROL MEASURED

I support political pressure on the Chinese to include but not limited to Boycott of the games. It’s the right thing to do. We should show the world that some Americans if not our president have a pro human rights agenda.[trb]

AL SHARPTON , Rolling Eyes why in the world does anyone continue to give that clown any kind of legitimate status ?

1987: Sharpton spreads the incendiary Tawana Brawley hoax, insisting heatedly that a 15-year-old black girl was abducted, raped, and smeared with feces by a group of white men. He singles out Steve Pagones, a young prosecutor. Pagones is wholly innocent -- the crime never occurred -- but Sharpton taunts him: "If we're lying, sue us, so we can . . . prove you did it." Pagones does sue, and eventually wins a $345,000 verdict for defamation. To this day, Sharpton refuses to recant his unspeakable slander or to apologize for his role in the odious affair.

1991: A Hasidic Jewish driver in Brooklyn's Crown Heights section accidentally kills Gavin Cato, a 7-year-old black child, and antisemitic riots erupt. Sharpton races to pour gasoline on the fire. At Gavin's funeral he rails against the "diamond merchants" -- code for Jews -- with "the blood of innocent babies" on their hands. He mobilizes hundreds of demonstrators to march through the Jewish neighborhood, chanting, "No justice, no peace." A rabbinical student, Yankel Rosenbaum, is surrounded by a mob shouting "Kill the Jews!" and stabbed to death.

1995: When the United House of Prayer, a large black landlord in Harlem, raises the rent on Freddy's Fashion Mart, Freddy's white Jewish owner is forced to raise the rent on his subtenant, a black-owned music store. A landlord-tenant dispute ensues; Sharpton uses it to incite racial hatred. "We will not stand by," he warns malignantly, "and allow them to move this brother so that some white interloper can expand his business." Sharpton's National Action Network sets up picket lines; customers going into Freddy's are spat on and cursed as "traitors" and "Uncle Toms." Some protesters shout, "Burn down the Jew store!" and simulate striking a match. "We're going to see that this cracker suffers," says Sharpton's colleague Morris Powell. On Dec. 8, one of the protesters bursts into Freddy's, shoots four employees point-blank, then sets the store on fire. Seven employees die in the inferno.

Last chance for redo of the primary(F)
Clinton Presses Obama on Efforts For Revotes in Florida and Michigan(W)
Clinton Facing Narrower Path to Nomination(NYT)
DNC won't give in on Fla., Mich., official warns(B)
HOW DID THIS HAPPEN?
The race is certainly not over. With 10 contests remaining, Mrs. Clinton trails Mr. Obama by about 150 delegates out of the 2,025 needed to secure the nomination.(NYT)

HILLARY IS DESPERATE

Obama alluded to a Clinton campaign ad and said: “What we need in our next commander in chief is not a stubborn refusal to acknowledge reality or empty rhetoric about 3 a.m. phone calls.”(K)
HILLARY WILL LOSE WITHOUT MICHIGAN

Despite Mrs. Clinton’s last-minute trip to Michigan on Wednesday, Democrats there signaled that they are unlikely to hold a new primary. That apparently dashed Mrs. Clinton’s hopes of a new showdown in a state she feels she could win, and it left the state’s delegates in limbo.(NYT)

OBAMA IS BETTER OFF LETTING HILLARY,BREWER AND MDP BOIL IN THEIR OWN STEW

Aides to the two candidates said even with the best possible showing for Mrs. Clinton in the states ahead, it was hard to see how she could pass Mr. Obama without Michigan and Florida. (NYT)

OBAMA: FOLLOW RULES BECAUSE I WILL WIN

INDIGNANT? SO THATS WHAT IT IS CALLED NOW!
Clinton, adopting an increasingly indignant tone, described the voting controversy in both states as part of a question of democracy -- albeit one that just happens to address her deficit in pledged delegates. "Senator Obama speaks passionately on the campaign trail about empowering the American people. Today I am asking him to match those words with actions," Clinton said. (W)

MARK BREWER NOT BARACK OBAMA DISENFRANCHISED MI VOTERS TO HELP CLINTON!

DEMOCRATS RULED BY ELITE SUPER DELEGATES

WHAT GOES AROUND COMES AROUND
"It would make no sense for the Obama campaign to give the Clinton campaign that extra ammunition," said an Obama supporter in the House. "That would make no sense at all." (W)

MY ENEMIES ENEMY IS MY FRIEND
Without new votes or a new plan for counting the disqualified ones, Clinton is likely to continue to trail Obama in pledged delegates even if she scores victories in Pennsylvania and several of the states that follow. Both Democrats are campaigning in upcoming states despite the six-week lull until the next contest; Clinton is scheduled to campaign in Indiana on Thursday. (W)

HILLARY NEEDS A MAKE OVER TO LOOK LIKE A WINNER
Good Luck(TRB)

Today is viewed as the final chance for the do-over primary because state House lawmakers, who would have to approve the primary legislation, are set to leave for a two-week spring recess, and it would be too late to organize the election by the time they return.(F)
Hopes for the second primary -- intended to resolve an impasse over the status of Michigan's delegation to the national convention -- flickered Wednesday as top backers of the idea, including U.S. Sen. Carl Levin and UAW President Ron Gettelfinger, lobbied Democratic legislators in separate conference calls with Senate and House members.(F)

WE ARE FAMILY, MY SISTER HILLARY AND ME..........
VOICES OF THE COMMON DEMOCRATS?
LIBERAL, THE NEW GOOD LABEL!

SNAKES IN A BASKET!

SMALL LIE OR CHARACTER?
Clinton's stop in Detroit pushed back her schedule in West Virginia. A stop in Huntington was moved to late afternoon. When she finally arrived, Clinton offered a different explanation for her tardiness. "We got off to a bit of a slow start this morning due to some weather delays," she told a group of veterans (W)
At a hastily arranged campaign stop yesterday in Detroit, rival Hillary Clinton challenged Obama to support new contests in Michigan and Florida, saying it would be "wrong and frankly un-American" to disenfranchise nearly 2.5 million voters.(B)
Her campaign accused Obama of blocking a revote, citing a memo issued earlier yesterday by Roosevelt and the rules committee cochairwoman, Alexis Herman, saying they believed the Michigan plan could pass muster with the party.(B)
Obama accused Clinton yesterday of being "completely disingenuous" on Florida and Michigan, telling CNN that she didn't show concern for the voters in the two states until "it looked like she would have no prospects of winning the nomination without having them count."(B)

PARTY UNITY NEEDED
It is in the interest of Mrs. Clinton’s campaign to portray the contest as being highly competitive. Her campaign is intent on combating Mr. Obama’s efforts to pick off superdelegates. And it is increasingly concerned that any sign that the window is closing could lead a Democrat like Al Gore or Speaker Nancy Pelosi to step in and urge Democrats to back Mr. Obama in the interest of unity.(NYT)
"They've got to find a way to get their act together on something as simple as voting. Or John McCain is going to start looking better and better," Machesky said.(F)

WHEN THIS IS OVER, WE DEMAND THE PUNISHMENT OF MARK BREWER

THANKS MARK
Finally, the poll showed that half of the progressives would like to see Michigan and Florida hold new primary contests—a desire that appears all but hopeless. And that just about guarantees a floor fight in Denver in September when those states, stripped of delegates by the national party for holding their primaries too early, are expected to try to seat their delegates.(U)

For Some Young Tibetan Exiles, Dalai Lama’s ‘Middle Way’ Is a Road to Failure (NYT)

HUMAN RIGHTS! STARTS AT HOME NANCY

A senior US lawmaker, Nancy Pelosi, has called on the international community to denounce China's rule in Tibet. (B)

"As a freedom-loving people, if we don't speak out about the Chinese oppression, then we have lost our right to speak on human rights," Pelosi told reporters. ( c)

MARCHING MONKS

WHAT DOES TIGHTEN SECURITY MEAN!

The Chinese authorities are continuing to tighten security following days of protests by Tibetans in the main city, Lhasa, and in surrounding provinces. (B)

NANCY MEETS WITH THE GOVERNMENT IN EXILE

Ms Pelosi, Speaker of the US House of Representatives, spoke out while holding talks in northern India with the Dalai Lama. (B) Beijing accuses the Dalai Lama of inciting the violence. (B)

LET FREEDOM REIGN

"If freedom-loving people throughout the world do not speak out

against China and the Chinese in Tibet, we have lost all moral authority to speak out on human rights," Ms Pelosi told a crowd of thousands of cheering Tibetan exiles, including monks and schoolchildren, in Dharamsala. (B)

CONGRESSIONAL JUNKET

Ms Pelosi's visit at the head of a congressional delegation was planned before the anti-China protests began. (B)

TABLOIDS CATCH NANCY HOLDING HANDS IN PUBLIC

Pelosi told the crowd at the temple in Dharamsala that it must be karma that brought her to India at such a difficult time. The Dalai Lama and Pelosi held hands as he escorted her around the temple( c)

Rifles and bayonets (B)

THIS IS THE NRA DREAM WORLD

AN ARMED INSURGENCY WITH WMD.

The Tibetans "were throwing stones at anything that drove by," Mr Kenwood said. (H)

"The young people were involved and the old people were supporting by screaming - howling like wolves. Everyone who looked Chinese was attacked," said 25-year-old Swiss tourist Claude Balsiger. (H)

OUT WITH THE OLD

"They attacked an old Chinese man on a bicycle. They hit his head really hard with stones (but) some old Tibetan people went into the crowd to make them stop," he said. (H)

THIS IS NO LONGER MIDDLE EARTH

RESTRICT THE PRESS

China is not allowing foreign journalists into Tibet. Troops have also sealed off towns in the surrounding areas where unrest has taken place, witnesses say. (B)

Protesters shot (B)

POLITELY(TRB)

On Thursday Chinese authorities admitted that members of the security forces had fired on Tibetan protesters. (B)

SELF DEFENSE? WORDS DO HURT!

Police wounded four protesters "in self-defence" last Sunday in Aba county, a Tibetan area of Sichuan province, Xinhua news agency said. (B)

THE CHINESE DO NOT DISCRIMINATE

Earlier this week, the Tibetan Centre for Human Rights and Democracy circulated photos of bodies with apparent gunshot wounds, which it said were the result of police firing indiscriminately at protesters. (B)

CONDI SPEAKS..

Now we are really in trouble.(trb)

On Thursday, US Secretary of State Condoleezza Rice held telephone talks with her Chinese counterpart, Yang Jiechi, in which she urged Beijing to show restraint. (B)

THE DALI DID IT!

But Mr Yang told her the protesters were trying to sabotage both the Olympics and social stability - and reiterated China's position that it blamed the Dalai Lama for the violence.(B)

LEADERSHIP? Or lack thereof!

President “ I have bought my tickets, Nancy just work this thing out!”(TRB)

George W. Bush, who ignored objections by China in October to award the Dalai Lama the Congressional Gold Medal, plans to attend the Games, according to the White House.(BC)

THE NEW VOICES

Tashi Phuntshok, 40, a resident of a dormitory for new refugees here, said he understood that the Dalai Lama’s political strategy was intended to spare more Tibetan lives. If he called for independence, Mr. Phuntshok said, there would be outright war. “His Holiness, he is kind-hearted,” Mr. Phuntshok explained. 1. “For us,” he said, “it should be full independence.” Tashi Phuntshok, 40, a resident of a dormitory for new refugees here, said he understood that the Dalai Lama’s political strategy was intended to spare more Tibetan lives. If he called for independence, Mr. Phuntshok said, there would be outright war. “His Holiness, he is kind-hearted,” Mr. Phuntshok explained. (nyt)

Tsering Dorje, 34, came out of an Internet cafe on the same road, having scoured the Web for the latest news inside Tibet. He regarded the “middle way” as still the soundest strategy, but said that China would have to respond favorably soon for Tibetans to keep faith in the concept. “It’s time for China to show whether it has the courage,” he said. “If China doesn’t change its stance, I will change my mind.”(nyt)

Samdhong Rinpoche, the prime minister of the Tibetan government in exile, said he recognized the “energy and fire” of younger, more radical exiles, but dismissed their expectations.(nyt) “They have all lived in a world of dreams,” he said. “And they are driven by emotions.”(nyt) “For us,...it should be full independence.”(nyt)

Which side do you fall when a people fight for freedom, I side with freedom.(TRB)

Tenzin Wangdue, who has spent the last 11 days shouting slogans, including some that the Dalai Lama would shun, is typical of the new generation. While not rejecting the Dalai Lama’s authority, he believes Tibetans have to push harder if they are going to get anywhere. “They’re not going to give total independence,” he said of China. “But I think there’s hope they’re going to accept genuine autonomy if we say we want total autonomy.”(nyt)

good luck....(TRB)

WHAT IS COHABITATION
Whether the trial court properly interpreted the term "cohabitation" as used in the judgment of divorce; Beason v. Beason; Birthelmer v. Birthelmer (Unpub. Ohio App.);

Whether the defendant-wife and her boyfriend were cohabiting; In re BZ; Attorney fees and costs under MCR 3.206(C); Gates v. Gates; Maldonado v. Ford Motor Co.; Reed v. Reed;

Whether the trial court properly relied on the "American rule" in denying defendant's request for attorney fees; Haliw v. City of Sterling Heights

Judge(s): Beckering, Bandstra, and Meter

MULTI FACTOR TEST=
17 YEAR MARRAIGE

COHABITATE AND YOU GET NO SUPPORT.

LONG-DISTANCE RELATIONSHIP

THE BOYFRIEND HAD HISOWN HOME

PROCEDURE
DIVORCED 1999 AFTER 17 YEARS

SHES LIVING WITH A GUY I WANT SUPPORT STOPPED...NOW!

I THINK THE COURT MESSED UP

THE JUDGEMENT DID NOT SAY WHAT COHABITATION MENT

The parties’ judgment of divorce did not define the term "cohabitation," and there are no
authoritative Michigan cases that define the term in the context of terminating an award of
spousal support.2

Therefore, it was appropriate for the trial court to consider the dictionary
definition of the term "cohabitation" and case law from other jurisdictions that have interpreted
the term in a similar context. See Henderson v State Farm Fire & Cas Co, 225 Mich App 703,
710; 572 NW2d 216 (1997), rev’d on other grounds 460 Mich 348 (1999) (where no Michigan
cases are directly on point regarding the meaning of a phrase, it is appropriate to turn to
dictionary definitions and case law from other jurisdictions).

THE DICTIONARY SAID
WHY DO WE HAVE SPOUSAL SUPPORT

The trial court explained that the purpose of spousal
support was to allow a spouse in need of support to continue to receive support after a divorce,
and that, if the recipient spouse cohabited with another person, such as her mother, the payor’s
responsibility to pay spousal support would not be abrogated. Id., slip op p 6.

COHABITATION MORE THAN LIVING TOGETHER?

THREE ELEMENTS OF COHABITATION
OTHER FACTORS IN DETERMINING COHABITATION

In addition to the three elements set out in Birthelmer, supra, the trial court considered
the following factors:

whether defendant and Walsh intended to cohabitate;

whether they held
themselves out as living together;

whether they assumed obligations generally arising from
ceremonial marriage;

whether a sexual relationship existed;

whether marriage was contemplated;

whether they used one another’s addresses;

whether they kept joint accounts;

whether they were
economically interdependent;

and whether defendant used her spousal support to subsidize the
alleged cohabitation.

Revolt of Michigan’s Common Democrats![trb]

DNC Rules Chair says Michigan; Hold caucuses.[D2] for the common democrat.[trb]

Roosevelt encouraged Michigan to return to its original plan, adopted before the Jan. 15 primary was set. Party caucuses had been planned for Feb. 9, and Roosevelt suggested the party could hold caucuses sometime in May or June. "The Michigan party knows how to run an alternative process," he said. [d2]

I am for the little (d) common Democrat. Its time we show up, stand up and speak up. What is needed is a demonstration of support for the proposition that Michigan must hold a caucus to re franchise Michigan at the National Democratic Convention. Forward this article to all of your democratic friends.[trb]

James Roosevelt Jr., a Massachusetts health-care executive is co-chair of the DNC's rules committee. [D2]

CALL TO ACTION FOR PRECINCT DELEGATES TO TAKE OVER THE MICHIGAN DEMOCRATIC PARTY!

The current non-leadership of the Michigan Democratic party wants to broker a Democratic Convention by leveraging its superdelegate vote.[trb]

The last thing they want is for the common democrat to assert its democratic voice at a caucus. Jesse Jackson taught the non-leaders currently in control of the Michigan Democratic party that they lose control if too many regular democrats get involved in the process. [trb]

This is about power, control and the maintenance of special privilege of the super delegates and their employees that currently run the Michigan Democratic Party. [trb]

The States precinct delegates should rise up and take over the Michigan Democratic party. Where is Sam Riddle when you need him?[trb]

THE CANDIDATES SHOULD FOLLOW US!

Who cares what the candidates think. This is our party and the Michigan leadership has screwed up and disenfranchised 500,000 voters. We need to throwout ( hold accountable) our leadership and gerterdone ASAP![trb]

Even if the candidates could agree, there were serious questions about whether party officials could conduct caucuses. In 2004, about 163,000 people voted at about 250 Democratic caucus sites. Party officials estimate that 2008 caucuses -- amid the closest nomination fight in recent history -- could attract as many as 2 million voters, requiring 1,000 or more caucus sites. [d2]

State Democratic Party postpones district conventions [D]did you know this?[trb]

Dems look at divvying up delegates
Candidates nix mail-in or caucus voting, so attention turns to a negotiated division.[d2]

WHO IS THIS PANEL?

The panel of four influential Democrats who proposed the do-over primary conferred again Friday afternoon, searching for an alternative that would be acceptable to the state and national parties, and Obama and Clinton. [d2]

WE MUST HOLD OUR LEADERSHIP ACCOUNTABLE TO REGAIN THE TRUST OF MICHIGAN VOTERS

Acknowledging that Michigan's delegate selection mess is unlikely to be resolved in the coming week, the state Democratic Party decided to postpone its congressional district conventions. [d]

A process of elimination is leaving Michigan Democratic leaders with a series of unappetizing choices: accept a negotiated split of the state's convention delegates, hope a nominee emerges who can lift the national party's ban on Michigan, or pursue a divisive, long-shot fight for the state's place in Denver[d2]

The 15 district gatherings, at which more than half of the Democratic delegates are elected to the Democratic National Convention in August, had been slated for March 29. [d]

Without a new election, Michigan could follow the path of Florida, which like Michigan held an unauthorized January primary and drew the delegate equivalent of the death penalty. Officials in Florida are working to strike a deal with the campaigns and the national party that would seat its delegates on a formula based only partially on the results of the state's Jan. 29 contest. [d2]

"Caucuses necessarily exclude too many people," said Clinton spokesman Phil Singer. Obama has consistently out-performed Clinton in caucus states[d2]

The state party's executive committee late Friday postponed the conventions until April 19. [d]

It remains to be seen whether the delegate picture will be any clearer by then. The national party stripped Michigan of its delegates because its Jan. 15 primary was held three weeks earlier than party rules allowed. [d]

An effort to have a do-over primary died in the Legislature earlier this week. On Friday, the Obama and Clinton campaigns ruled out two other options: a mail-in vote and a party caucus. [d]

That leaves as the only choices for seating delegates: Accepting a negotiated split of delegates; hoping a candidate emerges who will lift the party's ban on the seating of the delegates; or pursuing a long-shot appeal of party rules. [d]

Michigan is supposed to have 156 delegates to the national convention. Of that total, 83 are to be elected at congressional district conventions. Another 45 are picked at the State Party Central Committee meeting on May 17. The other 28 are uncommitted superdelegate, including elected officials and state and national party officials. [d]

WHO TOLD MARK BREWER TO VIOLATE THE RULES OF THE DNC THAT DISENFRANCHISED 500,000 MICHIGAN DEMOCRATS?

Levin and others have argued that New Hampshire and other states also changed the dates of their contests, violating party rules, and should have been punished as well. Michigan set its Jan. 15 contest only after New Hampshire's top election official announced in August that his state would move up. [D2]

With efforts to set up a June 3 state-run primary dead in Lansing, aides to presidential candidates Barack Obama and Hillary Clinton on Friday ruled out two likely alternatives: a mail-in primary or caucuses run by the Michigan Democratic Party. Even with approval from the candidates, either plan would face steep logistical hurdles. And there were few ideas beyond those two for how the state could hold a nomination contest that would bring it back within the national party's rules. [d2]

COMMON DEMOCRATS MUST FORCE THE MICHIGAN DEMOCRATIC PARTY AND ITS SUPER (duper) DELEGATES TO FOLLOW THE SUGGESTION , RULES,ORDERS,OF THE DNC, DEMOCRATIC NATIONAL COMMITTEE

THE DEMOCRATIC GOVERNOR OF THE STATE OF MICHIGAN MUST STEP FORWARD TO STRAIGHTEN THIS MESS UP AND REGAIN VOTER CONFIDENCE.

As always I am available to help.[trb]

_____

THE PLOT THICKENS
SPELLBINDING GREAT ENTERTAINMENT BUT NO WAY TO PICK A PRESIDENT!
It had Americans under its spell in the mid 1980s, but the combination of ever more insane storylines and endless pay disputes among its performers undermined it. Eventually the plug was pulled in 1989 with a cliffhanger tale in which the stars were imperilled but viewers never found out what happened to them. [t]

DENVER THEN AND NOW
Dynasty was set in Denver, Colorado. By appropriate coincidence, the Democratic national convention will occur in the same city in late August. [t]

The party is now under intense pressure to forge a solution that backers of both Senator Clinton and Barack Obama see as fair. "The real danger is a 1968 convention for the Democrats, where people felt cheated," says Ronald Rapoport, a political scientist at the College of William and Mary in Williamsburg, Va., alluding to one of recent history's most divisive and damaging conventions. [c]

OUR GRANDCHILDREN WILL NOT BELIEVE THIS STORY
FIRE ON THE HORIZON
DO THE MATH. Pledges (common democrats) plus Supers (elite Democrats) =nominee.
The situation today is as follows. It takes 2,025 delegates to secure a majority and with it victory. About 80 per cent of these Democratic stalwarts will be chosen by voters through primaries and caucuses (“pledged delegates”), the remaining 20 per cent are party leaders of various sorts (“super delegates”). [t]

COMMON DEMOCRATS WANT OBAMA,...SO FAR.

MICHIGAN AND FLORIDA ARE HELPING CLINTON,....NOT

Furthermore, two big states – Florida and Michigan – held primaries (in which Mrs Clinton did best) but have been barred from participating in the convention because they held them earlier than they had been instructed.[t]

With Obama's nearly insurmountable lead in pledged delegates, a revote in Florida and Michigan – or a recognition of the January results – was viewed as Clinton's best chance to narrow the gap and persuade superdelegates of a popular mandate for her candidacy.[c]

THIS IS CLEAR AS MUD
If this all sounds murky, it is about to become much, much worse. There are still a number of ballots to be held. The first is in Pennsylvania, which Mrs Clinton must, and probably will, win. Her rival then has a decent chance to hit back in North Carolina on May 6, where a large proportion of the electorate are African-Americans. Most of the remaining states (Indiana, West Virginia, Oregon, Kentucky, Puerto Rico, Montana and South Dakota) are likely to be inclined towards Mrs Clinton. [t]

WILL IT BE DOOR #1, #2 OR #3?
Such an outcome would result in three intriguing consequences.[t]
#1 MICHIGAN AND FLORIDA MESSED THIS UP

#2 THE SUPERS HAVE A MORAL OBLIGATION TO DECIDE FOR US, THE RACE IS NOT OVER UNTIL THE xxx LADY SINGS.

#3 VERY LITTLE TIME TO CLEAN THE MESS UP BEFORE THE ELECTION IN NOVEMBER.

FIFTY DELEGATES MAY DECIDE WHO THE NOMINEE IS
That cannot occur if it is uncertain who the champion will be. The party itself will have to run the convention in close, if tense, consultation with the two contenders. The policy details will become a proxy for the fight between the Clinton and Obama camps. No vice-presidential name can be put forward until the top of the ticket is determined. It is entirely possible that the nomination will be awarded on the basis of a margin of as few as 50 delegates, or fewer, out of more than 4,000 present. [t]

THOSE ELITE ENTITLED SUPER DELEGATES MAY DECIDE,PRIVATELY

The super delegates might overrule the pledged delegates, as they are entitled to, attracting intense controversy. [t]

HILLARY MAY BE LOSING THE SUPER DELEGATES SHE HAS SPENT A LIFE TIME CULTIVATING. HERE’S WHY.
The Hillary and Bill Clinton scorched-earth strategy of laying waste to Obama, or his supporters like Bill Richardson, is going to backfire among those in the only constituency who can put Hillary in the saddle. The super delegates.[N]

These people are professional politicians, officials and operatives who are horrified that the Clintons et Co. are producing negative soundbytes which will become fodder for the McCain side come the real contest in the fall. But this should come as no surprise .[N]

AFTER CONVENTION 8 WEEKS TO ELECTION
A bitterly divided party would then have about two months to bind its wounds before polling day in November.[t]

THE REPUBLICANS WILL LAUGH ALL THE WAY TO THE BANK, AGAIN.

Meanwhile, a few days later, the Republican convention will open in Minneapolis, a model of love, peace and unity compared with the Democratic showdown. [t]

MCAIN A BUSH SUPPORTING WAR MONGERING ,ECONOMY DEVASTOR, HAS BEEN, COULD WIN BECAUSE OF WHAT THE DEMOCRATS DO THEMSELVES

In one of the more crackpot Dynasty plotlines, Blake and Alexis end up running against each other for public office (the post of Governor of Colorado) but their expensive feud serves only to allow another candidate to emerge triumphant. John McCain has reason to hope that Mr Obama and Mrs Clinton are poised to do exactly the same, to his advantage. [t]
That leaves Democrats without delegates for the August national convention, the prospect of disillusioned voters — and an opening for Arizona Sen. John McCain, the presumptive GOP presidential nominee, in a state that has not gone Republican since 1988.[h]

"It's not breaking my heart," said Kent County GOP Chairman Dave Dishaw. "From a John McCain perspective, obviously I'm very excited that they can't get their act together."[h]

Jeff Williams, a senior vice president with Public Sector Consultants in Lansing, said it would be premature to assume all this chaos means the GOP will win Michigan. He believes the advantage still is with the Democrats.[h]

But he agrees McCain's image as a political maverick could help him win independents. His chances improve each week and month the Democrats fail to find a candidate, he believes.[h]

WOULD A REAL NON CANDIDATE LEADER STEP FORWARD, BUILD A COALITION AND GET THIS RIGHT....OUR FUTURE DEPENDS ON IT...AL GORE WHERE THE HADIES ARE YOU?
A ROUGH END GAME WILL BACK FIRE AND GIVE OBAMA THE NOMINATION
Short of a Hail Mary Pass, the Clintons are digging themselves an early, and permanent, party grave. More super delegates are going to follow Richardson’s lead even if Hillary pulls off Pennsylvania on April 22.[N]

National polls, after a rough week for Obama, have them tied and he is gaining again at her expense. But Obama has 730,000 more votes and 131 more super delegates than her and has it bagged even if she wins everything else in huge numbers.[N]

BUT WITH THIS DAMAGE CAN WE WIN THE GENERAL ELECTION
